Terms & Conditions (Version 2.2)

Welcome to OneRoad. These Terms govern your use of our NHVR-aligned Electronic Work Diary (EWD) and fleet tools. By installing or using OneRoad you agree to these Terms and our Privacy Policy.

What OneRoad is

OneRoad is a mobile platform for digital fleet & accreditation management: EWD, fatigue, maintenance, mass, and more—built for NHVR rules.

  • Drivers need a valid heavy vehicle licence; managers must be authorised for their business.
  • BYOD devices supported; offline logging with sync.

Your data

  • We collect work/rest logs, location, maintenance and qualifications to run the service.
  • Stored securely in Australia. Most compliance records retained 3 years (HVNL s341).
  • Optional features (e.g., job matching) require opt-in and limited data sharing.

Compliance & alerts

  • We help you comply — you are still responsible for following NHVR rules.
  • Alerts are guidance, not orders; you decide when to rest or stop.

Payments & email

  • Paid modules via Stripe. Cancel anytime; refunds follow Australian Consumer Law.
  • Record-keepers may receive mandatory compliance notices (can’t unsubscribe).

Do’s & don’ts

  • Enter accurate data; don’t share logins or tamper with records.
  • Misuse may lead to suspension or regulator reporting.

AI suggestions

  • AI generates tips; they may not fit every situation.
  • You remain responsible for decisions and compliance.

Definitions (alphabetical)

AFM – Advanced Fatigue Management under NHVR with flexible rules for eligible operators.

Authorised Data Access – Temporary, limited visibility for a verified third party with consent.

Australian Privacy Act 1988 – Law governing personal information and APPs.

Compatible Device – A device meeting minimum technical requirements to run OneRoad.

Electronic Work Diary (EWD) – NHVR-approved digital log for work/rest.

GDPR – EU data protection law (applies where relevant).

HVNL – Heavy Vehicle National Law (AU) for fatigue, work diary and safety.

In-App Purchases – Paid features/subscriptions processed via a third-party (e.g., Stripe).

Job Matching – Optional feature connecting drivers and third parties.

Maintenance/Mass Management – NHVR-aligned maintenance and weight compliance.

NHVR – National Heavy Vehicle Regulator (Australia).

Personal Data – Identified/identifiable information (e.g., contact, licence, location).

Platform – The OneRoad app and related services.

Privacy Policy – Our data-handling document on the website/app.

Third-Party Services – External integrations (telematics, payments, etc.).

User – Any individual using the platform (driver, manager, etc.).

1. Acceptance of Terms

By downloading, installing, registering for, accessing, or using OneRoad, you agree to be bound by these Terms and our Privacy Policy, including any feature-specific rules. If you do not agree, do not use the Platform.

  • Comply with all laws, including NHVR rules and Australian road safety standards.
  • Understand OneRoad supports — but does not replace — your compliance responsibilities.
  • Consent to data handling under the Privacy Act 1988, GDPR (where applicable), and our Privacy Policy.

We may modify these Terms at any time. Continued use after updates constitutes acceptance.

2. Eligibility Requirements

2.1 Legal and operational

  • 18+ years of age.
  • Drivers: valid heavy vehicle licence.
  • Managers/schedulers: authorised to act for your business.

2.2 Regulatory compliance

  • Comply with NHVR requirements (fatigue, maintenance, mass, access).
  • Maintain any AFM or other accreditations when applicable.

2.3 Technical

  • Use a Compatible Device with internet and location services enabled.
  • Keep the app updated to the latest version.
  • Maintain device GPS/clock/connectivity for accurate logs.

2.4 Truthful information

Provide accurate and up-to-date information during registration and use.

3. Licence to Use the Platform

We grant a limited, non-exclusive, non-transferable, revocable licence to use OneRoad on a Compatible Device for personal or authorised business purposes.

  • No resale, redistribution or sublicensing.
  • No reverse engineering or circumvention of protections.
  • No unlawful use or use inconsistent with NHVR/HVNL.

4. Data Collection, Usage, Storage & Retention

4.1 Data we collect

Work/rest logs, driver identification, location & time data, maintenance, mass, fatigue records, and relevant certifications.

4.2 Why we collect

To support NHVR compliance, generate audit reports, improve safety and functionality (alerts/recommendations), and enable optional features (e.g., Job Matching).

4.3 Conditional access

  • Internal (Fleet): Managers/record-keepers may view driver status, history, certifications, assets, allocations, etc.
  • External (Opt-in): Verified third parties may view limited info strictly while a feature is in use.

4.4 Storage & security

Data is stored in Australia with encryption and access controls; we conduct regular security reviews.

4.5 Retention

As an NHVR-approved EWD provider, we retain compliance records for 3 years in line with HVNL s341. Personal information is retained only as necessary for service provision.

4.6 Account deletion

You can request deletion via the app or support@oneroad.io. Personal profile, credentials, preferences and billing info are deleted. Compliance records required by law may be retained in de-identified form.

4.7 Your rights

Access, correction, and deletion (subject to legal retention). Contact support for requests.

4.8 Data breaches

We notify affected users and authorities under the Notifiable Data Breaches scheme.

4.9 Fleet retention

Personal data can be deleted from devices/app; relevant operational data remains with the fleet for three (3) years per NHVR/HVNL.

5. Device Requirements & Responsibilities

  • Keep device GPS/clock accurate and the app updated.
  • Sync data when online; extended offline use can risk data loss.
  • Protect credentials and report suspected breaches immediately.

7. Fatigue Alerts & Limitations

Alerts warn of upcoming rest requirements and potential breaches, based on data you provide and settings you choose. They are informational only, not legal advice.

8. User-Generated Data & Accuracy

You are responsible for truthful, complete entries. Inaccurate data can cause non-compliance and audit failures. OneRoad is not liable for errors or deliberate misreporting.

9. Code of Conduct

No tampering with logs, credential sharing, impersonation, or malicious code. Breaches may lead to suspension, termination, or regulator reporting.

10. Third-Party Integrations & Sharing

Integrations (telematics, payments, marketplaces) are opt-in and use minimal necessary data, only for the duration and purpose of the feature. Third parties are bound by our Privacy Policy and applicable laws.

11. Payments, Subscriptions & Refunds

  • Payments are processed securely via Stripe.
  • Subscriptions auto-renew unless cancelled.
  • Refunds follow Australian Consumer Law and processor policies.

12. System Availability & Downtime

We aim for reliability, but outages may occur. Limited offline use is available; you must sync when able. OneRoad is not liable for outage-related losses.

13. Mandatory Communications (Record-keepers)

Record-keepers may receive compliance-related messages that are required by law and cannot be unsubscribed from. For role updates, contact support.

14. Limitation of Liability

To the maximum extent permitted by law, OneRoad is not liable for damages arising from use, data errors, regulatory breaches, outages, or third-party interruptions. Consumer guarantees under the ACL apply.

15. User Indemnification

You agree to indemnify OneRoad for claims and costs arising from misuse, inaccurate data, or non-compliance attributable to your actions.

16. Modifications to Terms

We may update these Terms at any time. We’ll notify you in-app or by email. Continued use after changes constitutes acceptance.

17. Governing Law & Dispute Resolution

These Terms are governed by Australian law. Disputes should attempt informal resolution first, then mediation, arbitration, or courts as applicable. No class actions.

19. AI-Generated Suggestions

AI features provide general guidance based on your data. You remain responsible for decisions and compliance.
